NEW MICHIGAN SUPREME COURT RULE!

We advocated in support of the Michigan Supreme Court amending the landlord tenant court rules.  On September 7, 2023 the court adopted new rules that will go into effect on November 6, 2023.  Highlights include:

  • The summons (a notice to appear in court) has to include information informing the tenant they have a right to counsel.

  • The summons must also inform tenants about the availability of rental assistance and resources through the Michigan Department of Health and Human Services, and other resource agencies.

  • The court has to inform tenants of the right to counsel and the availability of rental assistance through an advice of rights at the first hearing.

  • If a tenant applies for rental assistance within 5 days of receiving the advice of rights, there is an automatic stay or pause on proceedings for at least 14 days.

  • The court must allow a person to appear using “video technology” or in other words, to appear virtually.

You can read the new rules here.

The road to housing justice is long, but these additional procedural changes acknowledge the necessity for tenants to have legal representation and easier access to the courts and housing resources to prevent eviction.
